This Acceptable Use Policy ("AUP") is made available to our customers to protect AccessGuardian.com ("Company") and our customers ("Subscriber") rights and responsibilities. This AUP may be updated at anytime and any changes will be made available from the Company's web site at http://www.accessguardian.com.
Internet Relationship
As no one entity controls or owns the Internet, it is the responsibility of the Subscriber to use their best judgment in the information that they obtain and share. The Company cannot 'police', monitor, validate, warrant, or affirm any information for accuracy or legitimacy that the Subscriber may obtain. As the Company cannot control the Internet, the Company cannot assume any responsibility for any use of information that the Subscriber may obtain. This includes but, is not limited to, injury, offense, or illegal activity. The Subscriber should also be aware that the Company does not regulate, edit, review, censor or take any responsibility for information the Subscriber shares through the Internet. Any information or content the Subscriber distributes through the Internet is subject to the same liability as any other Internet user such as copyright infringement, defamation, and other harmful speech or actions. Also, information that is transmitted through our network from the Subscriber can reach a large number of people on the Internet. Therefore, any Subscriber generated information may harm the Company's business reputation, service, or goodwill, will be considered a violation of the Company's AUP.
Scope and Purpose of Acceptable Use Policy
This AUP governs the services and products ("Services") offered by the Company. The Company may update this AUP at any time without notification. This AUP applies to all Subscribers and it's employees, agents, contractors or other users of the Subscriber ("User"). Every User is held responsible for using good and sound judgment in connection with these Services. Parents and guardians are required to always supervise any minors in using Services and the Internet in general.
Unauthorized and Prohibited Use
The following applies to both Subscribers and Users. Prohibited activity include, but are not limited to:
A. Illegal activity - use of Service to traffic or engage in illegal gambling, drug trafficking, pornography, obscene or offensive material, or any other activity that may be prohibited by applicable laws.
B. Usage of Copyrighted and Protected Material - utilizing Services to copy material such as text, graphics, audio, videos or other copyrightable material without proper authorization.
C. Software Distribution - use of Services to distribute any software whether legal or illegal as outlined in applicable laws.
D. Misrepresentation - use of Services with the intent to misrepresent or mask, in part or in whole, the originating message or intent. This includes any instance of spamming.
E. Malicious Intent - use of Services to cause harmful attacks such as, but not limited to, denial of service attacks whether to the Company or other Internet users or services.
Violations
Disclaimer. The Company expressly disclaims any obligation to monitor its Customers and other Users with respect to violations of this AUP. The Company has no liability or responsibility for the actions of any of its Customers or other Users or any content any User may post on any Web site.
Reporting Non-Copyright Violations. The Company encourages Users to report violations of this policy by e-mail to: support@accessguardian.com, including in any such report the name of the offending domain and the type of abuse in the “subject†field of the e-mail.
Remedies. If the Company learns of a violation of this AUP, the Company will respond to the applicable Customer and may, in the
Company's sole discretion, take any of the following actions, in accordance with the severity and duration of the violation:
- Warning the Customer; and/or
- Suspending the offending Customer from the Services; and/or
- Terminating the offending Customer from the Services; and/or
- Imposing fees or charges on the offending Customer account in accordance with the applicable service contract; and/or
- Taking other action in accordance with this AUP, the applicable service contract or applicable law.
Reservation of Rights. The Company reserves the right to cooperate with appropriate legal authorities in investigations of claims of illegal activity involving the Company's Services, Customers and other Users. The Company reserves all other rights to respond to violations of this AUP to the extent of applicable law and in accordance with any applicable contractual obligations. The Company may utilize technical means to monitor communications into, and out of, its network facilities to prevent the introduction of viruses or other hostile code, to prevent intrusions and otherwise to enforce this AUP and each Customer agrees that the Company is authorized to monitor its communications through the Company’s network for such purposes.
